(even though they have their own boards. ;) )

Can't say much about it but there is some exciting news on that front.
Please no speculation :P.

If the game is going to be released not-for-profit we'll be able to negotiate something though. I guarantee it. Again, I can't say as much as I'd like to.

If you lookup copyright infringement law under the violation called "confusion", you'll see that any similarity might be a disadvantage if this ever gets taken to court. (robots... levels... fonts...) But they're not making money off this game, so even if they try to take this to court, the violators will never be able to afford the fine, leaving the copyright holders with large legal fees. However, that does not mean that won't try and take them to court.

The community has gone through this before with Valen's project. If they hadn't wanted money they would have been fine. He contacted lawyers for both companies and had his own.
This really is a non-issue.

Woody, It basically has to be free. Not so much because of Interplay, (although that would certainly create a snag) but because of the license for using the UDK on this level. It's about $99 a seat and iirc, no money can be made on it ...that or a very small amount.. like $700 or some such. It's been too long since I've read the agreement. If they break this agreement, then they're on the hook for a LOT of money.

Valen's project got shot down because of (in his words) the blood feud between Parallax and Interplay. Rights to the game were divided up just weird enough to keep it from being simple as I recall. He had a post here on the whole matter before the site crashed number of years ago. So the fundamental message was "no, you can't for profit." That directly cut across licenses held on both sides. So that "Officially" killed the project as he was unwilling to do it for free. ... that and there were some "internal disagreements" that were creating their own set of road blocks.

The website has been created without any funding as far as I know. Same with the teaser -- we just happen to have a lot of talent on our team. You've probably figured out The Ascent Project guy is in charge of modelling. Incidentally, Verran is in charge of music -- and even I'm in charge of something I'm good at! As well as working on the music team.
There's nothing decided yet and I really can't say anything except that copyright won't be an issue no matter how we end up doing it. So you don't need to worry about that ;). Just take my word on it for now, please.

I haven't heard anything from Valin since he made his original thread and we exchanged PMs briefly about something that could have been his project.

Glad you're discussing the game here. After all this is the first place where I announced it initially, in October.

As Fox stated, we have been in talks with the current copyright holders and although the outcome is undetermined at this point, we have not been held back by them to make the game for free. So it's either that (under the Sol Contingency name) or it may also become an official Descent game. At that point it would factor in the licensing cost for the engine and also the fees paid to Interplay for the Descent name, so then it would be priced as a commercial game.

As always, the new website (which I made myself almost entirely, no funding there) will be your #1 source of info on that. And the teaser trailer was made by two people from our team. Good quality doesn't need to have money behind it.

If there is some kind of IP infringement (copyright, trademark, etc) they probably can C&D you, though the title is probably the only thing close to that here. Reinterpreting works is generally not a violation.

Yes, total conversions (mods) and other freeware can be made and distributed, provided they're not making money off it. The models and artwork and music all have to be made completely from scratch, you can't re-use any original material. You also cannot call it "Descent". You can say its a "Descent mod" and the like, but it cannot carry the name.

Valin failed because when he left MSDS, no permissions went with him. He got too big for his britches and thought he could negotiate his own deal and make Descent 4 for money, which was never really an option given the situation with the copyright owners during that time frame. If he had stayed put and did what I told him, D4 could have been done along time ago. Of course, it wouldn't look as good as this is looking (modern engines, yay!)

I for one, hope you guys do strike a new deal and are able to revive the franchise. You're its last best hope!

Since my last post I found out that in the US there is a potential issue with "derivative works" which is a little fuzzy - if it can be considered that, then unless it also qualifies for "fair use", there might still be problems. Maybe. If anyone cares.
