This is the artical concerning the Cop who was shot and killed:

They have done a blood workup on him and discovered he was drunk - very drunk. The local news is polling people to get an opinion on how important this factor is in his death here:

woa, that's 4X the legal limit to be driving a car here (0.05%).
definitely drunk.

The article says he was at twice the legal limit, at .20%. But his partner was at under 1/5 the legal limit at .13%. Somebody dropped a zero somewhere...

Strange that he got shot due to a confrontation unrelated to his undercover assignment. Sounds like he was drinking a bit too much, and chances are, so was the other guy.

The partner's BAC was listed as 0.013%, not 0.13%. I haven't heard of this story before, but it does sound suspicious; it'll be interesting to see if they find out what actually happened.

.013 is barly a buzz, might even be considered sober. But it was the sober one they approached and accosted. He called for Vick to return and help him out and poop hit the fan from there. If these events turn out to be correct I really dont think his being drunk makes a big difference on a murder charge.
