the article states that the suite was due to "over due work", but last we read it was for money's not provided to Bethesda due to poor backing.

Well, Daikatana did get released...though maybe it would have been better for everyone if it wasn't.

Why couldn't they leave it at "they dropped it" and move on? If I could guess the percentages of what will happen, I'd give a:

30% chance of succeeding
20% chance of Bethsuda digging something else up to counter their counter
50% chance of failure, losing EVEN MORE MONEY, and putting everything on hold.
Bonus 5% chance that if the 50% senario does happen, that they will go bankrupt as well.
