He can use the symbol, but the problem comes when he tries to sue someone else's use of it. There's tons of examples of this. It's happened with cartoon characters, names, and this concept even extends to patents. Remember, like most government offices, the patent/trademark/copywrite office will take your money.

Yep. That image is public domain. You can't pull it out of public domain and his claim only applies to the new logo he made with changes, which is not what other people have copied. This is really just a goof by Zazzle and they need to implement better controls to avoid this sort of stuff.
