Want to disarm your neighbor?

Post by Nightshade »

...in Connecticut? Just file a restraining order.
Gun control fascists: Connecticut’s Democratic legislature has have passed a new law, which the Democratic governor has signed, allowing the government to confiscate the firearms of anyone placed under a temporary restraining order.

"Temporary restraining orders are routinely granted with little or no examination of the underlying facts and based wholly on one-sided testimony. Such a process is certainly appropriate in cases of domestic abuse, stalking, and the like. But with the implementation of this new law the subject of the restraining order is punished without ever having his day in court. In fact, they are punished without ever even being accused of, let alone convicted of, a crime. The TRO does not require a crime to have been committed – just a feeling of danger."

Now, if you hate guns and you live in Connecticut, all you have to do is say that you feel threatened by someone, and the government can take that person’s guns. No trial, no evidence, no Constitutional rights. The feelings of a person trumps all!

Note the pattern. Almost all of the people trying to ban free speech and our Constitutional rights are leftists, be it either Democratic politicians, leftwing academics, or communist student groups. Yet, these same people are going to claim that no one should vote for Donald Trump, because he, in league with the Republicans, is going to take away our Constitutional rights.

Temporary restraining orders have to be obtained from a judge. It takes work. It's not like you can zip down to the local store and get one immediately without effort. These orders are only for a fixed amount of time and are used only as a stop-gap measure and the party that wants the restraining order must also convince that judge that they are in fear of immediate danger or irreparable harm. I'd say it's a reasonable idea if someone fears that another person my harm or kill them in the immediate future. Hell, guns seem to be the weapon of choice for solving domestic disputes by one of the aggrieved parties.

Two words: "Due process"... That said, where can I get one ? My neighbor was shooting his BB gun in the back yard and I felt threatened. :twisted2:

as stated by TC, you just don't 'file' a restraining order.....it has to be declared to be necessary by a judge. No problem with this at all.

Yea, we need to take away their guns, because the restraining order will definitely keep the person from getting close enough to use a knife.

once again, Spidey with the 'you can't stop them all' thinking to preclude considering laws that would prevent SOME senseless violence. Yeesh.

If that is what you think I meant, it’s not even worth explaining.

that was clearly what your prose suggests, so if you don't mean that, work on your writing skills. Don't blame me and cop out from there......

Just wait until he shoots out one of your windows in the dark of night. It's so loud when it shatters that it will sound just like someone was shooting a real gun at your house.

No slick, spidey I believe meant that anyone can try to get a restraining order if all it takes is feeling threatened. Know someone owns guns? Just apply for a temp. restraining order to get his guns taken away. And BTW, does the guy get his guns back when the temp. time period is up? What shape will they be in after the police manhandle them? What if the guy has a collection of expensive firearms and they are damaged? Will he be able to sue or get restitution for the diminished value?

Your not crediting the judge who has to issue the restraining order with any intelligence.

and, as has been noted, repeatedly, a JUDGE has to accept your proof of threat. My issue with Spidey was the sarcastic remark about the truly abusive being able to get a knife. Of course, they could, but it has been long shown that guns are more effective, lethal and quick to result in an irreversable result.

And BTW, does the guy get his guns back when the temp. time period is up? What shape will they be in after the police manhandle them? What if the guy has a collection of expensive firearms and they are damaged? Will he be able to sue or get restitution for the diminished value?
you realize we do have civil courts for that? Nothing in that proposed law would suggest a right to keep, damage or do a damned thing, except store them as long as the court order is in effect. If the authorities screw up, an insurance claim or civil claim should handle damage. Also worth noting is your built-in paranoia about our law enforcement community. Hmmmm.

Lots of luck suing a govt agency. By the time you pay the lawyer fees you might as well let the cops keep the guns. And don't start on criticizing the police. You do it also.

Hah! Nice "I'm rubber you're glue" copout and missed-point combo.
