The lawsuits usually do get tossed -- but it still costs the company money and attention to make it happen. The company being sued still has to show up in court and argue that the suit should be tossed -- and that costs money, and could be a huge hassle for small restaurants. Why not cut it off at the head?

because it's not really necessary to pass laws to stop rewarding people for their stupidity.

If you really want to cut it off at the head, people should be taught some common sense. that getting burned on their lap because they dumped their coffee (which might have been intentional) doesn't give them carte blanche to sue a company.

I'd rather see the next frivolous lawsuit not only tossed out but the plaintiff's picture posted everywhere for public embarrassment.
