Why couldn't they leave it at "they dropped it" and move on? If I could guess the percentages of what will happen, I'd give a:

30% chance of succeeding
20% chance of Bethsuda digging something else up to counter their counter
50% chance of failure, losing EVEN MORE MONEY, and putting everything on hold.
Bonus 5% chance that if the 50% senario does happen, that they will go bankrupt as well.
