The problem with Obama thinking the Gitmo detainee's have served their time long enough, is they have not. If we indeed have a war on terror, those caught fighting should not be released until the war is over. As it stands:
"(CNSNews.com) - The Director of National Intelligence released a report this week indicating that the United States has "confirmed" that 116 detainees "transferred" out of the prison at Guantanamo Bay, Cuba, subsequently reengaged in terrorist or insurgent activities."
This would be like releasing captured German soldiers before WW2 was over so they could fight some more.

They declared war on us, therefore its official, whether we like it or not.
That kind of thinking is way too conventional, for the modern version of war.
I have heard the 21st century referred to as the century of terrorism, in contrast to the previous one, that was the one of modern conventional war.
Sure it would be great if there were some kind of rules, but we are going to have to slog this thing out, for now, without proper guidelines…unfortunately.

Since they do not wear a uniform I guess it would be easier to just execute them.

It seems like we already do execute them, since almost a quarter of those released have been
killed and another quarter have been recaptured.
For the sake of proper evaluation, this "news" woody posted refers to a single
source with lots of questionable "quotation marks," horrible presentation of data, excitable language, and a clear partisan slant. Comments are taken from republicans who single out Obama, yet the majority of the detainees in the report who returned to terrorist activity were released by Bush in the years before the 2009 executive order to close the prison. Surprisingly, the article actually points out the Obama administration does a better job of risk assessment than Bush's, but that information is down at the bottom where most people don't read because they have already glazed over from confirmation bias.
Reading between the lines, if this report is correct we have waaaay more intelligence in that region than I ever suspected, which actually hurts people looking to make a case against the Bergdahl exchange.
Finally, and sadly, these "terrorists" who have rejoined the ranks are killing many, many more Muslims in the Middle East than Americans anywhere.

Orrrr we could try them and prosecute them as criminals. Which they are. Deeming them "soldiers" lends far more credence to their cause than it deserves.

I didn't say anything about cops, but if we have these people in custody, we need to either charge them with a crime and put them on trial, or let them go. Indefinite detention without legal cause makes us no better than they are.

No, you didn’t say a word about cops, but you did infer that these freaks were some kind of simple criminals, and should be treated as such. The statement about not calling them “solders” pretty much says it all.
Funny how people walk both sides of the street on this one…if we mistreat them…people scream Geneva convention (which only applies to legal combatants) then if they get treated as “soldiers” people scream…they are just common criminals.

We don't have them in 'custody' as the U.S. criminal justice system defines it. You just choose to see it that way. We have them held prisoners during a war on foreign soil as our military defines it. Politicians are the fuckup that happens between the lines because they can over-ride the military regardless of outcome.
You are seeking a politically expedient outcome. That usually is in the best interest of the politician and any benefit the US citizen gains from those kind of choices are happy mistakes. Any non-benefit that arises is tossed around rhetorically between the political factions in an attempt to pin the blame on the opponent.
