It certainly is a blank check to oppress the people. It also sounds like it was written to make it possible to justify stop and search so that any evidence uncovered is admissable. Probably have a lot of gang type activity and now the cockroaches will have to stay in the shadows since the police can go roust them any time three or more are seen together...meanwhile I'm betting the 'bake-sales-are-now-illegal interpretation wouldn't be used.
I wouldn't vote for it because I prefer the model where cops are smarter than the robbers. But this makes it easy to hire basic security guard types instead to keep the streets clean of riff raff. (I would have used 'thugs' instead of riff raff, but some fools think only black people can be thugs and I don't want to contribute to their confusion)

When a town outlaws swearing (speech), gathering of three or more people (assembly) and a curfew (movement), then you have a big, big problem.

I'd agree but I'm guessing the town's administrators are reacting to a different problem that is pretty big too, thus their motive for creating this solution that has a side effect of creating the (potentially) big problem you are pointing to.

There are already laws on the books to address whatever come up. Provincial laws. Federal laws.

Perhaps the town officials are protecting themselves against all the bad language directed towards them for being piss poor administrators?

well, what you guys can do is let your other circles know about this. Maybe if it gets enough attention, they'll hit the brakes on it and remove it from their bylaws.

Well you tell me why they have decided to create this new law then.
If it isn't in reaction to something those existing laws are not adequate to handle what is it?
You think they really want to outlaw swearing and bake sales?!?
It makes more sense that they want to have legitimate cause to harrass certain people engaged in certain activities in public.

It blew me away, too. As for what it's in reaction to, only the members of the council who enacted this know why. The fact that they even passed this just smacks of oppression. But this isn't a debate topic. This isn't about who's view is more correct. This is about a town stepping WAY over its limits and into an indefensible and unjustifiable position.
The quoted passages are straight out of the bylaw, copied word-for-word. Hold on to your head, it's going to explode.
Part 1
Curfew period: means the period of time between 11:00 pm and 6:00 am, per day
Part 2
No minor shall be in a Public Place during the Curfew Period unless accompanied by a Parent or Guardian
No Parent or Guardian shall suffer, permit or allow any Minor who is in his or her custody, care or control, to be in a Public Place during the Curfew Period unless that Minor is accompanied by a Parent or Guardian
Part 4
Fighting/Loitering/Assembly of persons
No person shall be a member of the assembly of three or more persons in any Public Place where a Peace Officer has reasonable grounds to believe the assembly will disturb the peace of the neighborhood, and any such person shall disperse as requested by the Peace Officer.
Part 5
Noise:
No person shall yell, scream or swear in any Public Place
Now who gets to decide what is reasonable, hm? If you're just sitting around on a bench in the evening with a few of your friends at 11:30, how is that a crime? Last I checked, you have to be caught in the act to be charged with something, or they have to have sufficient evidence to charge a person with a crime. Being told to disperse because a peace officer believes the group is about to do something is not justification enough.
This is a country built upon laws and freedom, where people are innocent until proven guilty. Trying to punish anyone for pre-crime is straight out of movies like minority report.
