Listening to the Factor, I understand the 9th circuit is at it again. Seems like a shoot 'em in the back killer is going to walk. The reason? Seems the victims relatives wore little lapel pins with the victims picture on it. Gosh darn, this is comparable to walking the perp into court wearing chains as to how the jury may be influenced.
Remember in another topic how it was brought up that a court decision affects later decisions? In this case the 9th jerk-it extrapolated their decision from a prior rape case where t-shirts were worn declaring rape in unflattering terms. The rapist walked.
So I guess on the left, it is alright to have activist judges but not when conservative appoint them.

From a legal perspective, I can understand it. The jury needs to live in a bubble.
